Cruise Line Argues Grandfather Was Negligent

Yesterday, the 11th Circuit Court of Appeal sent the wrongful death case against Royal Caribbean Cruises back to the lower court. The grandfather of a toddler who fell to her death on a cruise ship unquestionably knew the risks of his granddaughter being near the edge of the ship. The cruise line argues that the grandfather was negligent in his supervision of the toddler.

The incident occurred in 2019 when the grandfather was on a Royal Caribbean cruise with his granddaughter. The grandfather was watching the toddler play when she fell overboard. The cruise line immediately launched a search, but the toddler was never found.

The grandfather filed a wrongful death lawsuit against Royal Caribbean Cruises. The grandfather claims that the cruise line was negligent in failing to provide adequate safety measures to prevent the toddler from falling overboard. The cruise line argues that the grandfather was negligent in his supervision of the toddler.

The 11th Circuit Court of Appeal agreed with the lower court that the grandfather knew the risks of his granddaughter being near the edge of the ship. However, the court sent the case back to the lower court to determine whether the grandfather was negligent in his supervision of the toddler.
